Description

DEP is responsible for operating, maintaining and protecting the City’s upstate water supply. For more than twenty years, DEP has been operating the Catskill/Delaware water supply under specific terms mandated by the series of Filtration Avoidance Determinations, most recently issued as the 2017 Filtration Avoidance Determination (FAD). Pursuant to the Revised 2-17 FAD, the City agreed to provide additional funding for CW Corp.’s related operational costs, the services of the Stormwater Technical Assistant position and certain construction management services in connection with the construction of CW Corp.’s office building (“Arkville Facility”) located at 669 County Route 38, Arkville, New York. Section 3.5 of the 2017 FAD issued by the NYSDOH also requires the City to contract with CW Corp. to provide adequate funding for an appropriate position at CW Corp. to assist applicants undertaking regulated activities to comply with the stormwater provisions of the Watershed Regulations (Stormwater Technical Assistant). Operating Funds under this contract may be used only to pay the operating costs of CW Corp. incurred on or after the effective date, including, without limitation repayment of any CFF loan, and costs related to the Arkville Facility (“CW Corp. Operating Costs”)
