Description

Pursuant to Procurement Policy Board (“PPB”) Rules Section 3-04(b)(2)(iii), the Mayor’s Office of Criminal Justice (“MOCJ”) requests approval to procure services via Negotiated Acquisition Extension (“NAE”) for the continuation of Citywide homicide and non-homicide trial-level criminal indigent defense representation services for the following vendors: The Legal Aid Society (“LAS”), Brooklyn Defender Services (“BDS”), Bronx Defender Services “BXD”), New York County Defender Services (“NYCDS”), and Neighborhood Defender Services of Harlem, Inc. (“NDS”). MOCJ anticipates awarding an NAE to all current providers for a term of 12 months beginning July 1, 2026 to June 30, 2027 for a total not to exceed amount of $755,108,468.50. The vendors will perform the same scope of work as set forth in their respective base contracts.

1-year NAE is justified to ensure continuity of critical trial-level legal representation services pending the release of the City’s next Criminal Trials RFP. At this time, an RFP has not been released, and no evaluation has been conducted. MOCJ has been in active conversation with the Administration regarding the RFP release and now anticipates a likely release of the RFP in Fall 2027, with new RFP Contracts beginning Fiscal Year 2028.
