NOTICE OF A JOINT PUBLIC HEARING of the Franchise and Concession Review Committee and the New York City Department of Parks & Recreation (“Parks”) to be held on 9/8/2025, at 255 Greenwich Street, 8^th Floor, in Manhattan, New York, NY 10007 commencing at 2:30 p.m. relative to:

INTENT TO AWARD as a concession for the operation and maintenance of a high-quality food stand and outdoor café at Madison Square Park to Custard’s First Stand, LLC (“Licensee”). 

The License will provide for a one (1)-year term with two (2) one (1)-year renewal options.

Compensation will be as follows:

Pursuant to a preexisting agreement between the Madison Square Park Conservancy and Parks, 100% of the annual concession fees from the licensee’s operations will be directed to the Conservancy  to support  Madison Square Park and Worth Square. The fees for each year will consist of the greater of a guaranteed minimum annual fee or a percentage of gross receipts per the schedule below:

Written testimony may be submitted in advance of the hearing electronically to fcrc@mocs.nyc.gov. All written testimony can be submitted up until the close of the public hearing and will be distributed to the FCRC after the hearing.

A draft copy of the agreement may be obtained at no cost by any (or all) of the following ways:

1. Submit a written request to NYC Parks  at philip.abramson@parks.nyc.gov from 8/22/2025 through 9/8/2025.
2. Submit a written request by mail to NYC Parks, Revenue Division, 830 Fifth Avenue, Room 407, New York, NY 10065. Written requests must be received by 9/8/2025. For mail-in requests, please include your name, return address, and Concession # M52-SB.
