New York City Economic Development Corporation (NYCEDC) invites law firms and lawyers to submit proposals for the provision of on-call outside counsel services to NYCEDC in connection with matters that may arise concerning interstate commerce and rail and maritime transportation matters. NYCEDC anticipates that the services will include: (i) providing assistance with litigation before New York City (City), state and federal courts, (ii) advocating on behalf of NYCEDC and /or the City before relevant administrative agencies such as the Surface Transportation Board, the Federal Railroad Administration and the Federal Maritime Commission, and (iii) drafting, reviewing and negotiating documents in connection with, amongst other things, large scale development projects.

NYCEDC plans to select on-call outside counsel on the basis of the factors stated in the RFP which include, but are not limited to: prior experience in providing similar services, prior experience in performing legal services for a governmental, quasi-governmental or similar not-for profit entity, the quality of the respondent’s management, litigation reputation, and references, as well as respondent’s favorable history, if any, in contracting or doing business with the City and/or the NYCEDC, the proposed fee schedule and the respondent’s overall expertise and organizational strength.

It is the policy of NYCEDC to comply with all federal, state and City laws and regulations which prohibit unlawful discrimination because of race, creed, color, national origin, sex, age, disability, marital status and other protected category and to take affirmative action in working with contracting parties to ensure certified Minority and Women-owned Business Enterprises (MWBEs) share in the economic opportunities generated by NYCEDC’s projects and initiatives. Companies who have been certified with the New York City Department of Small Business Services as Minority and Women Owned Business Enterprises (“M/WBE”) are strongly encouraged to apply. Questions regarding the subject matter of this RFP should be directed to interstaterailcounselRFP@edc.nyc. Answers to all questions will be posted by Monday, October 7, 2024, to https://edc.nyc/rfps. Questions regarding the subject matter of this RFP will not be accepted after 5pm on Monday, September 30, 2024, however, technical questions pertaining to downloading and submitting proposals to this RFP may be directed to RFPREQUEST@edc.nyc on or before Tuesday, October 15, 2024.
