Under Section 3-04(2)(i)(D) of the Procurement Policy Board rules, an agency may procure services through negotiated acquisition based upon a compelling need for services that cannot be timely met through competitive sealed bidding or competitive sealed proposals. Here, the Mailroom Automation initiative is in a time-sensitive situation to develop and deploy a system by which incoming hard copy mail (predominately legal documents) can be digitized to be delivered to responsible parties in near-real time. Additionally, the system will permit distribution in a more secure method to better protect sensitive and/or confidential information such as personally identifying information and, delivering digitally permits multiple responsible parties to receive an identical piece of mail simultaneously, an impossibility with a single piece of hard copy mail. This system is required in order to permit recipients (legal staff) to more quickly and efficiently prioritize and strategize their significant caseloads. This is especially important considering the Agency’s increased vacancy rate as it impacts our ability to timely and effectively manage the increasing incoming legal caseloads. There is a compelling need for these services to be procured as soon as possible to ensure that the Law Department has the greatest possible opportunity to quickly and efficiently manage the voluminous number of matters being litigated by the City of New York.
