CORRECTED PUBLIC HEARING NOTICE
NOTICE IS HEREBY GIVEN THAT A REAL PROPERTY ACQUISITIONS AND DISPOSITIONS PUBLIC HEARING, in accordance with Section 824 of the New York City Charter, will be held on April 10, 2024 at 10:00 a.m. via Conference Call No. 1-646-992-2010, Access Code 717 876 299.
IN THE MATTER OF a renewal of the lease for the City of New York, as tenant, on the entire ground floor and a portion of the 2nd floor of the building located at 34-09 Queens Blvd, (Block 242 & Lots 9) in the Borough of Queens for the Exams Division of New York City Department of Citywide Administrative Services to use as a exam testing center, or for such other use as the Commissioner of the Department of Citywide Administrative Services may determine.
The proposed use was approved by the City Planning Commission pursuant to NYC Charter Section 197c on April 18, 2001 (CPC Appl. No. 990480 PCQ, Public Hearing Cal. No. 19).
The proposed renewal of the lease shall be for a period of ten (10) years from Substantial Completion of alterations and improvements, at an annual rent of $792,133.00 from Execution to Substantial Completion, $834,951.00 from Substantial Completion through year five (5), and $956,982.30 years six (6) through ten (10), payable in equal monthly installments at the end of each month. In addition to the first payment of rent due under the Lease, Tenant shall pay to Landlord, a one-time payment equal to the product of $6,664.83 (the difference between the current rent under TNH [$59,346.25] and new rent at execution [$66,011.08] x the number of months from January 1, 2021 to Lease Execution.
The renewal of the lease may be terminated by the Tenant at the end of five (5) years, in whole, or at any time thereafter, provided the Tenant gives the Landlord twelve (12) months prior written notice. In the event that the lease is terminated by the Tenant, the Tenant shall pay a termination fee of $778,644.42, reduced by 20% every 12 months after the fifth (5th) year.
The Landlord shall prepare final architectural plans and engineering plans and make alterations and improvements at Landlord’s sole cost and expense, for both Tenant and Base Building Work, in accordance with preliminary architectural plans and specifications which are attached to the lease.
