NOTICE IS HEREBY GIVEN THAT A REAL PROPERTY ACQUISITIONS AND DISPOSITIONS PUBLIC HEARING, in accordance with Section 824 of the New York City Charter, will be held on March 27, 2024 at 10:00 a.m. via Conference Call No. 1-646-992-2010, Access Code 717 876 299.

 

IN THE MATTER a renewal and amendment of the existing lease for the City of New York, as tenant for the entire building located at 300 Gold Street (AKA 131-143 Flatbush Avenue), Brooklyn, NY 11201(Block 133, Lot 5) in the Borough of Brooklyn for the Department of Citywide Administrative Services for use by the New York City Police Department for general, administrative and executive offices, for ancillary parking, and for other uses reasonably ancillary thereto, or other similar use as the Commissioner of DCAS may determine, subject the terms and conditions thereof.

 

The proposed use was approved by the City Planning Commission pursuant to NYC Charter Section 195 on February 7, 2024 (CPC Appl. No. N240013PXK, Public Hearing Cal. No. 3).

 

The proposed renewal and amendment of the existing lease shall be for a period from the execution of the Lease Renewal and Amendment Agreement (“Amendment”) until October 31, 2028. The annual base rent shall be in the amount of (i) $1,269,623.06 per annum from the execution of the Amendment until substantial completion of repairs and other work to be performed by the Landlord pursuant to a scope of work annexed to the Amendment (“Landlord’s Work”) and (ii)  $1,345,800.00 per annum from the substantial completion of the Landlord’s Work until October 31, 2028. Base Rent will be payable in equal monthly installments at the end of each month.  In addition, within 60 days after the Landlord’s substantial completion of the Landlord’s Work, Tenant shall pay Landlord an amount equal to the sum of  $6,348.08 per month for the period from October 16, 2023 until the substantial completion date of the Landlord’s Work (prorated for any partial month), representing the difference between the base rent payable upon substantial completion of the Landlord’s Work and the base rent paid by Tenant under the holdover provisions of the expired original lease for the period from October 16, 2023 until the execution of the Amendment and for the period immediately following until the substantial completion of the Landlord’s Work.

 

The existing lease, as renewed and amended by the Amendment, may be terminated by the Tenant as of October 16, 2027, or any time thereafter, with at least 180 days prior written notice to the Landlord.

 

The Landlord will perform the Landlord’s Work as more specifically provided in the Amendment.
