NOTICE IS HEREBY GIVEN THAT A REAL PROPERTY ACQUISITIONS AND DISPOSITIONS PUBLIC HEARING, in accordance with Section 824 of the New York City Charter, will be held on May 12, 2021 at 10:00 a.m. via Conference Call No. 1-646-992-2010, Access Code 717 876 299. 

 

IN THE MATTER OF a renewal of the lease for the City of New York, as Tenant, for the entire building located at 165-15 Archer Avenue (Block 10155, Lot 29) in the Borough of Queens for the Administration for Children’s Service for use as an office and for Department for the Aging to use as senior center or for such other use as the Commissioner of the Department of Citywide Administrative Services may determine.

 

The proposed use was approved by the City Planning Commission pursuant to NYC Charter Section 197-c on April 25, 2015 CPC Appl. No. 6 Public Hearing Cal. No. C150149 PQQ.

 

The proposed renewal of the lease shall be from execution (the “Lease Commencement”) to November 5, 2027, at an annual rent of $2,652,575 from November 6, 2020 to November 5, 2022, at an annual rent of $2,783,703.75 from November 6, 2022 to November 5, 2025 and at an annual rent of $2,891,388.94 from November 6, 2025 to expiration, November 5, 2027, payable in equal monthly installments at the end of each month.

 

Additionally, along with the first rent payment there will be a one-time payment equal to the product of $32,352.08 times the number of months, and partial months, from November 6, 2020 to Lease Commencement.

 

The lease may be terminated by the Tenant at any time on or after November 6, 2025, provided the Tenant gives the Landlord one-year prior written notice.

 

The Landlord shall make alterations and improvements in accordance with specifications which are attached to the lease. The alterations and improvements consist of Base Building Work, which the landlord shall provide at its sole cost and expense.

IN THE MATTER OF a lease for the City of New York, as tenant, of the entire building of interior space, exterior yard space, and exterior parking at the property located at 25 14th Street (Block 1031, Lot 1 and Block 1031, Lots 62, 67, and part of 71) in the Borough of Brooklyn for the Fleet Services Division of the Department of Transportation to use as an office, maintenance garage, and warehouse, or for such other use as the Commissioner of the Department of Citywide Administrative Services may determine.

 

The proposed use was approved by the City Planning Commission pursuant to NYC Charter Section 197c on October 17, 2018 (CPC Appl. No. C180418 PCK) Public Hearing Cal. No. 7).

 

The term of the proposed lease is the balance remaining of the twenty (20) year period following the commencement of the existing License on February 28, 2017, (a term of approximately sixteen (16) years from execution of the lease), at an annual rent of $1,567,000.00 from lease commencement through February 28, 2022, $1,802.050.00 from March 1, 2022 through February 28, 2027, $2,072,357.50 from March 1, 2027 through February 29, 2032 and $2,383,211.10 from March 1, 2032 through February 28, 2037, payable in equal monthly installments at the end of each month.

 

The lease may be terminated by the Tenant, in whole or in part, effective any time after the fifth (5th) year of the lease, provided the Tenant gives the Landlord one hundred eighty (180) days prior written notice. In the event that the lease is terminated by the Tenant, the Tenant shall pay to the Landlord the sum of $159.84 per day from termination date to expiration date.

 

The Tenant shall have the right to renew the lease for a period of five (5) years at 95% of Fair Market Value.

 

The Landlord shall prepare final architectural plans and engineering plans and make alterations and improvements in accordance with preliminary architectural plans and specifications which are attached to the lease.  The alterations and improvements consist of Base Building Work, which the landlord shall provide at its sole cost and expense, and Tenant Work.  The total cost of the final architectural plans and engineering plans for the Tenant Work and the Tenant Work shall not exceed $14,041,525 of which the Landlord shall contribute $193,270 and the balance up to $13,848,255 will be paid by the Tenant.   The Tenant shall reimburse the Landlord for the Tenant’s share of the costs as further defined in the lease.

IN THE MATTER OF a Lease Reinstatement and Modification of the lease for the City of New York, as tenant, for space on the 4th floor of the building located at 111 Washington Avenue (Block 20000, Lot 1) in the City of Albany for the New York City Council to use as an office or for such other use as the Commissioner of the Department of Citywide Administrative Services may determine.

 

The proposed Reinstated lease shall be for the period from execution to midnight of October 13, 2030 at an annual rent of $32,727.45 for the period execution to midnight of October 13, 2022; then, $32,951.10 for the following three (3) years and $33,249.30 for the last five (5) years, payable in equal monthly installments at the end of each month.

 

Tenant shall have the use of three parking spaces.  Two will be at no rent.  The rent for the third space is $2,376.00 for the period of execution to midnight of 10/13/25; and $2,616 for the next 5 years.

 

The extension of lease may be terminated by the Tenant at the end of two (2) years, or at any time thereafter, provided the Tenant gives the Landlord sixty (60) days prior written notice. 

 

Landlord shall perform work at its sole cost based on a Scope of Work.
