Notice of Public Hearing

 

NOTICE IS HEREBY GIVEN THAT A REAL PROPERTY ACQUISITIONS AND DISPOSITIONS PUBLIC HEARING, in accordance with Section 824 of the New York City Charter, will be held on April 5, 2017 at 10:00 a.m., 1 Centre Street, Mezzanine, Borough of Manhattan.

IN THE MATTER OF a lease for the City of New York, as tenant, of approximately 9,897 rentable square feet of space on the 1st and 2nd floors of the building located at 101 Tyrellan Avenue (Block 7469, Lot 170) in the Borough of Staten Island for the Infrastructure and Public Buildings Division of the Department of Design and Construction to use as an office, or for such other use as the Commissioner of the Department of Citywide Administrative Services may determine.

 

The proposed use was approved by the City Planning Commission pursuant to NYC Charter Section 195 on December 12, 2016 (CPC Appl. No. N170133 PXR) Public Hearing Cal. No. 17).

 

The proposed lease shall be for a period of twenty (20) years from the Date of Substantial Completion of alterations and improvements, at an annual rent of $454,750.00 for years one through five, $522,963.00 for years six through ten, $601,407.00 for years eleven through fifteen, and $691,618.00 for years sixteen through twenty, payable in equal monthly installments at the end of each month.  The first two months of the first year’s rent will be abated.

 

The lease may be terminated in whole or in part by the Tenant effective as of the 10th anniversary, or at any time thereafter, provided the Tenant gives the Landlord 90 days’ prior written notice.  In the event that the lease is terminated by the Tenant, the Tenant shall pay to the Landlord the unamortized portion of Landlord’s contribution to the Tenant’s cost of alterations and improvements, the free rent and the tenant’s brokerage commission to the space to be relinquished.

 

The Tenant shall have the right to renew the lease for two (2) periods of five (5) years each at 95% Fair Market Value.

 

The Landlord shall prepare final architectural plans and engineering plans and make alterations and improvements in accordance with preliminary architectural plans and specifications which are attached to the lease.  The alterations and improvements consist of Base Building Work, which the landlord shall provide at its sole cost and expense, and Tenant Work.  The Tenant Work Cost shall not exceed  $2,199,179 The Landlord shall pay the first $200,625 and the balance up to                                               $1,998,554 will be paid by the Tenant in accordance with the lease.

 

IN THE MATTER OF a lease for the City of New York, as Tenant, of approximately 25,133 rentable square feet of space consisting of 18,393 square feet of interior space and 6,740 square feet of exterior roof play area, in a a building located at 1435 Prospect Place (Block 1361, Lots 66 & 67) in the Borough of Brooklyn for the Administration for Children’s Services to use as a Day Care Center, or for such other use as the Commissioner of the Department of Citywide Administrative Services may determine.

 

The proposed use was approved by the City Planning Commission pursuant to NYC Charter Section 197c on March 8, 2017 (CPC Appl. No. 160072 PQK) (Public Hearing Cal. No. 10).

 

The proposed lease shall commence on the lease execution date and expire ten (10) years following substantial completion of alterations and improvements at an annual rental of $691,157.50, payable in equal monthly installments at the end of each month.

 

Upon one hundred and eighty (180) days prior notice, the proposed lease may be terminated by the Tenant at anytime after the fifth (5th) full lease year following Substantial Completion. 

 

The Landlord shall prepare final plans and make alterations and improvements in accordance with plans and specifications attached to the lease.  The alterations and improvements consist of Tenant Work. The total cost of the Tenant Work shall not exceed $1,310,214.35 and the Tenant shall reimburse the Landlord for Tenant Work, to be disbursed upon the substantial completion of the alterations and improvements.
