Description
The City of New York Law Department (“Department”) intends to enter into negotiations with one or more law firms in order to award a contract for the provision of legal representation in support of FLSA-related litigation. The Department has determined that it is in the City’s best interest to retain outside counsel to assist in this litigation.

Contract award will be by the Negotiated Acquisition method of source selection, pursuant to City of New York Procurement Policy Board Rules (“PPB Rules”) §§ 3-04(b)(2)(iv)(A), 3-04(b)(2)(i)(D), 3-04(b)(4) and 3-04(b)(6), because it has been determined that it is not practical or not advantageous to award the proposed contract by competitive sealed bids or competitive sealed proposals, that there is a time-sensitive situation where a supplier must be retained quickly, that there is a limited number of suppliers available and able to perform the work, and that award of the proposed contract by the Negotiated Acquisition method of source selection is in the City’s best interest.

It is anticipated that the contract to be awarded through this Negotiated Acquisition will have a term commencing as of March 20, 2003 and continuing through the final disposition of the case.

As a result of its market research, the Department has determined to enter into negotiations with a limited number of law firms with expertise in the Fair Labor Standards Acct (“FLSA”). Due to severe litigation-related time constraints, the Department has determined to solicit Statements of Qualification from firms it believes to be well qualified to provide the legal representation. The firms solicited for this procurement are as follows: (1) Bryan Cave, (2) Morgan Lewis, (3) Epstein Becker, (4) Seyfarth Shaw, and (5) Littler Mendelsohn.

Any qualified firm which wishes to express interest in being considered for such procurements in the future, and in being placed on the Department’s bidders list for such services, is invited to so indicate by letter to the following address: Samuel A.
